Necessary defense (§ 29 TZ)

Necessary defense allows anyone to defend themselves or others from attack. The key is that the defense must not be blatantly disproportionate to the attack method.

Necessary defense conditions

• Aktualita: The attack must be directly threatened or ongoing.
• Limits: The defence must not be manifestly and grossly disproportionate to the manner of the attack. There is no obligation to use greater force; the specific circumstances must be assessed.
