Detention of a person (§ 76 of the Code of Criminal Procedure)

Under Section 76(2) of the Czech Code of Criminal Procedure, anyone may restrict the liberty of a person caught committing a criminal offence or immediately afterwards where necessary to establish identity, prevent escape or secure evidence. Mere suspicion or a breach of venue rules does not replace these requirements.

Handover to police: The person must be handed over to the police immediately. If immediate handover is not possible, the restriction of liberty must be reported to the police without delay. This does not give security staff police investigative powers.
